Under Kenya's Employment Act 2007, an employment contract must include: the names and addresses of both parties, the date of commencement, the job title and job description, the place of work, working hours, remuneration and benefits, leave entitlements, and the notice period for termination.
Under South Africa's BCEA, a written employment contract must include: full names of both parties, the job title and description, the place of work, commencement date, ordinary hours of work, remuneration, leave entitlements (annual, sick, family responsibility), and the notice period. For fixed-term contracts, the reason for the fixed term and its expiry date must also be included.
A probation period is not legally required in most countries, but is recommended best practice. It gives both employer and employee a trial period to assess the employment relationship. Probation periods typically range from 1 to 6 months depending on the role and country.
